1. Booking and Payment
1.1
Bookings are confirmed upon receipt of payment or as specified in a separate booking agreement.
1.2
Time extensions beyond the booked session will incur additional charges. Any session that exceeds the scheduled end time by 10 minutes or more will be charged for a full additional hour at the standard rate.
1.3
Cancellations must be made at least 72 hours in advance to qualify for a refund or rescheduling without penalty. Late cancellations may result in forfeiture of payment.
1.4
Pricing is subject to change at the sole discretion of The Foundry Recording Studio at any time. However, confirmed bookings will honor the rates in effect at the time of booking confirmation.
1.5
A non-refundable deposit may be required to secure bookings, particularly for extended sessions or after-hours use. The amount of such deposit will be specified at the time of booking.
2. Facility Usage
2.1
Clients agree to use the studio facilities and equipment with care and in accordance with these terms and any additional instructions provided by The Foundry Recording Studio staff.
2.2
Clients shall vacate the studio promptly at the end of their booked session.
2.3
Clients must leave all rooms in the same condition as found at the beginning of the session. This includes:
- Returning all equipment and furniture to original positions
- Removing all personal items and trash
- Reporting any issues, damage, or technical problems to staff
2.4
Volume levels must be maintained at reasonable levels respectful of others using the building. Staff may request volume reduction at their discretion.
2.5
The Foundry Recording Studio reserves the right to refuse the use of any outside equipment that may pose a risk to the facility's systems or that may be incompatible with existing equipment.
3. Conduct and Prohibitions
3.1
The following are strictly prohibited on The Foundry Recording Studio premises:
- Smoking or vaping of any kind
- Alcoholic beverages or illegal substances
- Weapons of any kind, including but not limited to firearms, knives, or any object that could be used as a weapon
- Open flames, candles, incense, or any fire hazards
- Placement of drinks, food, or liquids on or near audio equipment, mixing consoles, or other electronic equipment
- Aggressive, disruptive, sexually explicit, lewd, obscene, or offensive behavior of any kind
3.2
All clients and their guests must conduct themselves in a professional and courteous manner toward other patrons, clients, and staff members.
3.3
Violation of these prohibitions may result in immediate termination of the session without refund and potential restrictions on future bookings.
3.4
Theft of any kind, including but not limited to equipment, accessories, or intellectual property, will not be tolerated and will result in immediate legal action, including but not limited to civil litigation and/or criminal prosecution to the fullest extent of the law.
3.5
Do not exceed the maximum number of participants allowed per session unless otherwise agreed in writing. Additional participants may result in additional charges.
3.6 Zero-Tolerance Policy: Sexual Misconduct, Harassment & Obscene Conduct
The Foundry Recording Studio maintains a strict zero-tolerance policy toward sexual misconduct, sexual harassment, lewd behavior, and obscene acts of any kind. The following behaviors are strictly prohibited on The Foundry Recording Studio premises and during any studio-related activity:
- Sexual harassment, unwanted sexual advances, or inappropriate physical contact
- Lewd, obscene, or sexually explicit acts, gestures, comments, or materials
- Indecent exposure or sexual activity of any kind
- Verbal, physical, or visual conduct of a sexual nature that creates an intimidating, hostile, or uncomfortable environment
- Any behavior that violates applicable local, state, or federal laws regarding sexual conduct or public decency
This policy applies to all clients, artists, producers, engineers, guests, contractors, and visitors, without exception.
3.7
Immediate Enforcement & Removal: Any violation of this policy may result in immediate termination of the session without refund, removal from the premises, and permanent prohibition from future bookings at The Foundry Recording Studio. The Foundry Recording Studio reserves the right to take enforcement action without warning and without obligation to provide a refund or credit, regardless of session length or remaining booked time.
3.8
Reporting & Legal Action: Behavior that constitutes sexual misconduct, harassment, lewd conduct, or criminal activity may be:
- Documented internally
- Reported to appropriate authorities
- Subject to civil or criminal legal action
The Foundry Recording Studio will fully cooperate with law enforcement and legal proceedings where applicable.
3.9
Client Responsibility for Guests: The individual responsible for the booking assumes full responsibility for the conduct of all guests, collaborators, and participants associated with the session. Any violation by a guest shall be treated as a violation by the booking client and subject to all consequences outlined in these Terms and Conditions.
4. Overnight and After-Hours Bookings
4.1
Definition: "Overnight" or "After-Hours" bookings refer to any studio usage outside standard operating hours as defined by The Foundry Recording Studio management and posted at the facility.
4.2
Primary Responsibility: The individual named in the booking agreement for overnight or after-hours sessions (hereinafter the "Responsible Party") assumes the role of temporary caretaker of the facility and shall be personally present for the entire duration of the booking.
4.3
Access and Security:
- The Responsible Party shall ensure all exterior doors remain securely locked at all times except when specifically admitting authorized participants
- The Responsible Party shall maintain a log of all individuals entering and exiting the premises during the booking period
- No individuals other than those specifically identified and approved prior to the booking may be admitted to the premises
- The Responsible Party shall not duplicate, share, or loan access credentials (keys, cards, codes) under any circumstances
4.4
Enhanced Liability:
- The Responsible Party assumes full legal and financial responsibility for the entire building, all equipment, and all persons present during the after-hours booking period
- Any damage, loss, or incident occurring during the booking period, regardless of who caused it, shall be the sole financial responsibility of the Responsible Party
- The Responsible Party agrees to indemnify and hold harmless The Foundry Recording Studio from any claims, damages, losses, liabilities, costs, and expenses arising from the use of the facility during the after-hours booking
4.5
Safety and Emergency Procedures:
- The Responsible Party must complete a mandatory safety orientation before the first after-hours booking
- The Responsible Party must be familiar with all emergency exits, fire extinguisher locations, first aid supplies, and emergency protocols
- The Responsible Party shall maintain clear access to all emergency exits at all times
- In case of any emergency, the Responsible Party must first ensure the safety of all occupants, then immediately contact emergency services, followed by the emergency contact provided by The Foundry Recording Studio
4.6
Stricter Prohibitions:
- No entry to unauthorized areas of the building
- No use of equipment not specifically included in the booking agreement
- No sleeping or lodging on the premises beyond the scope of brief rest periods
- Maximum occupancy limits as communicated by The Foundry Recording Studio must be strictly observed
4.7
Deposit and Insurance:
- A substantial security deposit, as specified in the booking agreement, is required for all after-hours bookings
- The Responsible Party must provide proof of valid liability insurance with minimum coverage requirements as specified by The Foundry Recording Studio
4.8
Termination:
- The Foundry Recording Studio reserves the right to terminate after-hours access privileges permanently for any violation of these terms, with no refund of fees paid
- Remote monitoring systems may be in use to ensure compliance with these terms
5. Liability and Insurance
5.1
The Foundry Recording Studio is not liable for:
- Personal injury occurring on the premises
- Loss, theft, or damage to client equipment, instruments, or personal belongings
- Loss or corruption of session files or data, regardless of cause
5.2
Clients are advised to maintain their own insurance coverage for equipment and personal injury.
5.3
Clients shall be responsible for any damage to The Foundry Recording Studio's property, equipment, or facilities caused by the client or their guests through negligence, misuse, or failure to follow proper operating procedures.
5.4
By using our facilities, clients agree to indemnify, defend, and hold harmless The Foundry Recording Studio, its owners, employees, and agents from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising out of or related to the client's use of the studio.
6. Intellectual Property
6.1
The Foundry Recording Studio makes no claim to ownership of any intellectual property created during studio sessions.
6.2
The Foundry Recording Studio reserves the right to use the client's name, images, and general session information for promotional purposes unless otherwise agreed in writing.
6.3
Clients are responsible for securing all necessary rights, licenses, and permissions for any copyrighted material used during their sessions.
7. Data Storage and Backup
7.1
The Foundry Recording Studio will maintain session files for a period of 2 days after recording, after which they may be deleted without notice.
7.2
Clients are strongly encouraged to make their own backups of all session files before leaving the studio.
7.3
The Foundry Recording Studio charges a storage fee for maintaining session files beyond the standard 2-day period. This fee will be specified at the time of booking.
8. Force Majeure
8.1
The Foundry Recording Studio shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, government restrictions, power outages, or other unforeseen events.
8.2
In the event of such occurrence, The Foundry Recording Studio will make reasonable efforts to reschedule bookings affected by such events.
9. Privacy and Confidentiality
9.1
The Foundry Recording Studio respects the confidentiality of all client sessions and will not disclose details of projects to third parties without client consent.
9.2
Clients agree not to disclose confidential information about The Foundry Recording Studio's equipment, methods, or business practices to third parties.
10. Miscellaneous
10.1
The Foundry Recording Studio reserves the right to refuse service to anyone at its sole discretion.
10.2
These terms and conditions may be updated periodically. The current version will always apply to all bookings.
10.3
Any exceptions or modifications to these terms must be agreed upon in writing by authorized representatives of The Foundry Recording Studio.
10.4
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
11. Governing Law
11.1
These terms and conditions shall be governed by and construed in accordance with the laws of Pennsylvania, without giving effect to any choice of law or conflict of law provisions.
11.2
Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Pennsylvania.
12. Non-Compliance Consequences
12.1
Any breach or failure to comply with these Terms and Conditions by clients or their guests shall, at the sole discretion of The Foundry Recording Studio, result in one or more of the following consequences:
- Immediate termination of the current session without refund
- Forfeiture of any deposits or prepayments
- Permanent ban from future bookings at the facility
- Financial liability for any resulting damages, losses, or remediation costs
- Legal action including but not limited to civil suits for damages, specific performance, or injunctive relief
- Reporting to relevant authorities where violations constitute criminal offenses
The Foundry Recording Studio reserves the right to determine the appropriate consequence(s) based on the nature and severity of the non-compliance.
By booking and using The Foundry Recording Studio facilities, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
